CONDIZIONI GENERALI DI VENDITA Versione: S01-2018

1. Le presenti Condizioni Generali di Vendita regolano le condizioni contrattuali relative all‘acquisto e all‘utilizzo delle tessere a tempo e a valore Dolomiti SuperSummer.Entrambe le tessere sono dei meri titoli di trasporto per persone che consentono di utilizzare gli impianti di risalita delle imprese che abbiano aderito all‘iniziativa Dolomiti SuperSummer, il cui elenco è reso disponibile presso ogni punto vendita, presso i principali impianti di risalita aderenti, nonché pubblicato sul sito internet DOLOMITISUPERSUMMER.com.Le tessere Dolomiti SuperSummer vengono accettate, con le specifi cazioni di cui ai successivi articoli 3 e 4, agli impianti aderenti nel periodo che va dal 01/06/2018 al 04/11/2018. Non tutti gli impianti sono operativi durante l‘intero periodo indicato. Nell‘elenco di cui sopra sono indicati, per ciascun impianto aderente, il periodo e l’orario di apertura.2. La Federconsorzi Dolomiti Superski, quale soggetto emittente i titoli di trasporto sopracitati, così come pure i Consorzi di zona a quest’ultima aderenti, agiscono in forza di mandato con rappresentanza conferito loro da parte di imprese autonome esercenti il trasporto a mezzo impianti a fune (i mandanti), a cui competono l’esercizio e la gestione esclusiva dei rispettivi impianti e la relativa responsabilità dei servizi di trasporto. Le imprese esercenti il trasporto per mezzo di impianti di risalita aderenti all’iniziativa Dolomiti SuperSummer, insieme agli utenti, sono pertanto gli unici ed esclusivi contraenti del presente contratto di trasporto, per il quale è esclusa ogni partecipazione e responsabilità da parte della Federconsorzi Dolomiti Superski e dei Consorzi di zona, agendo entrambi in nome e per conto delle imprese aderenti all’iniziativa.3. L‘uso della tessera a tempo ai varchi di accesso consente al titolare legittimato l‘utilizzo degli impianti di risalita aderenti all’iniziativa Dolomiti SuperSummer. La tessera ha un periodo di validità rispettivamente di un giorno, di tre giorni anche non consecutivi su quattro, oppure di cinque giorni anche non consecutivi su sette, a seconda del tipo di tessera acquistata. Il periodo di validità della tessera non può in alcun modo essere modifi cato.La tessera a tempo è un titolo strettamente personale, porta impressi i suoi giorni di validità, nonché una sigla composta alternativamente dalle lettere M/F/J e B, che rispettivamente identifi cano l’appartenenza dell’utente alla categoria Maschio - Femmina - Junior (nato dopo il 01/06/2002) e Bambino (nato dopo il 01/06/2010). Essa può recare il nome e cognome e/o la foto del titolare legittimato al suo utilizzo. I dati personali degli utenti non vengono conservati, né su supporto cartaceo, né in alcuna forma elettronica. Non viene pertanto eff ettuato alcun trattamento dei dati personali.La tessera a tempo non può essere ceduta a terzi, neanche a titolo gratuito, né scambiata o alterata. Al fi ne di ottenere lo sconto praticato a Juniores (J) e Bambini (B) sulle tessere a tempo, è necessaria, contestualmente all’atto di acquisto della tessera a tempo, la loro presenza fi sica e l’esibizione di validi documenti di riconoscimento, non sostituibili da autocertifi cazione, attestanti i presupposti per la concessione del suddetto sconto nei casi e nella misura indicati nel presente foglio illustrativo e informativo disponibile nei punti vendita, nonché pubblicato sul sito internet DOLOMITISUPERSUMMER.com.La tessera a tempo per Bambini (nati dopo il 01/06/2010) è gratuita e viene concessa a fronte del contestuale acquisto a titolo oneroso da parte di un accompagnatore maggiorenne di una tessera a tempo della stessa tipologia e per lo stesso periodo, alla quale la tessera gratuita viene abbinata; la gratuità è intesa nel rapporto un Bambino (B) per un accompagnatore maggiorenne pagante. La tessera a tempo consente il trasporto delle sole persone. Per il trasporto di bici, passeggini, valigie, animali e altri oggetti e accessori, troveranno applicazione le condizioni previste dai singoli impianti di risalita per tale trasporto. L’utente dovrà quindi informarsi presso le casse dei singoli impianti di risalita per tale trasporto. Gli impianti contraddistinti con l’apposito bollino* non consentono il trasporto delle bici.4. La tessera a valore, invece, non è personale, e quindi è cedibile e la sua validità è limitata alla stagione estiva di emissione. L‘uso della tessera a valore ai varchi di accesso consente al titolare e ai suoi accompagnatori l‘utilizzo degli impianti di risalita contenuti nell‘elenco di cui sopra, con l’esclusione degli impianti presso i quali essa non viene accettata. Al momento dell‘acquisto la tessera a valore avrà un iniziale saldo attivo rispettivamente di 800 o di 1.400 unità, a seconda del tipo di tessera acquistata. A ogni suo utilizzo, verranno scalati dall‘ammontare residuo presente sulla tessera le unità necessarie per il singolo impianto di risalita utilizzato, il tutto nella misura specifi cata nell‘elenco più volte menzionato e comunque in quella indicata presso la stazione di partenza dell’impianto aderente e sul sito internet DOLOMITISUPERSUMMER.com.La tessera a valore consente il trasporto delle sole persone. Per il trasporto di bici, passeggini, valigie, animali e altri oggetti e accessori, troveranno applicazione le condizioni previste dai singoli impianti di risalita. L’utente dovrà quindi informarsi presso le casse dei singoli impianti di risalita per tale trasporto. Gli impianti contraddistinti con l’apposito bollino* non consentono il trasporto delle bici.Al Bambino nato dopo il 01/06/2010, accompagnato da un titolare maggiorenne di una tessera a valore in corso di validità, verrà concesso da parte dell’esercente di ciascun impianto di risalita, il libero accesso e passaggio all‘impianto. A quest’ultimo competeranno gli adempimenti fi scali eventualmente necessari. Al momento dell’utilizzo dell’impianto andranno esibiti validi documenti di riconoscimento, non sostituibili da autocertifi cazione, attestanti i presupposti per la concessione della suddetta gratuità. La gratuità è vincolata all’utilizzo della tessera a valore all’impianto ed è intesa nel rapporto di un Bambino (B) per un accompagnatore maggiorenne pagante.5. All’inizio e alla fi ne della stagione estiva, è possibile che vengano chiusi singoli impianti di risalita, gruppi di impianti di risalita o zone più ampie di impianti di risalita, oltre che per i motivi indicati all‘art. 13, anche in considerazione delle condizioni

di affl uenza, di disponibilità di percorsi e sentieri e di sicurezza. L‘eventuale chiusura avviene in base a decisioni che verranno assunte autonomamente dai singoli gestori degli impianti di risalita e alle quali la Federconsorzi Dolomiti Superski e i singoli Consorzi di zona rimangono del tutto estranei.6. Oggetto del contratto è soltanto il trasporto di persone dalla stazione a valle alla stazione a monte del singolo impianto di risalita e/o viceversa. Ogni ulteriore attività (trekking, mountain bike, anche all‘interno dei “Bike Park” e strutture similari, ecc.) non è oggetto del contratto ed è intrapresa da ogni singolo soggetto esclusivamente a proprio rischio e pericolo. I sentieri e percorsi non sono di proprietà degli esercenti degli impianti di risalita, né della Federconsorzi Dolomiti Superski o dei Consorzi di zona, i quali dunque non li gestiscono in alcun modo e non provvedono alla loro verifi ca e/o manutenzione. La Federconsorzi Dolomiti Superski e i Consorzi di zona non sono altresì proprietari di alcun “Bike Park” o similare e quindi non sono responsabili della loro gestione e sorveglianza, che competerà esclusivamente ai soggetti gestori e/o proprietari degli stessi. Gli utenti hanno in ogni caso l’obbligo di osservare e rispettare diligentemente le Disposizioni per i Viaggiatori esposte alla partenza di ogni impianto.7. Il gestore dell’impianto utilizzato declina ogni responsabilità per i danni derivanti dall’uso improprio degli impianti, nonché per le conseguenze di comportamenti illeciti posti in essere dagli utenti durante la loro permanenza sugli impianti. Con l‘utilizzo dell‘impianto, l‘utente delle tessere Dolomiti SuperSummer dichiara di essere a conoscenza delle responsabilità civili (artt. 2047 e 2048 c.c.) connesse alla sorveglianza del minore, anche nell‘uso degli impianti, nonché di attenersi a tutte le disposizioni e normative, nazionali, regionali e provinciali, vigenti in materia. Il trasporto del bambino avviene sotto la tutela, la responsabilità e la vigilanza dell’accompagnatore maggiorenne, con l’esclusione di ogni responsabilità da parte dell’esercente di ciascun impianto di risalita; resta comunque sottointesa la responsabilità da parte dei genitori o di chi ha la legale rappresentanza dei minori per l’uso da parte di quest’ultimi degli impianti di risalita.8. A ogni richiesta degli addetti agli impianti e degli ispettori, gli utenti dovranno esibire le tessere Dolomiti SuperSummer e consentire la propria identifi cazione.9. Qualsiasi abuso nell’utilizzo dei titoli di viaggio sopra menzionati, comporta il loro ritiro immediato, il loro annullamento o la loro sospensione. Entrambe le tessere a tempo e a valore possono altresì essere ritirate o sospese dai soggetti competenti al controllo in caso di violazione di leggi nazionali, regionali o provinciali. In caso di abuso con tessere a tempo concesse ai Bambini (B) di età inferiore agli 8 anni, viene bloccata e/o ritirata sia la tessera gratuita, sia quella a cui è stata abbinata al momento dell’acquisto. Ogni abuso verrà perseguito a norma di legge, con riserva di proporre o avviare ogni azione utile a far accertare la responsabilità penale (p.es. per truff a - art. 640 c.p.) e civile del trasgressore.10. È esclusa qualsiasi forma di sostituzione o rimborso delle tessere a tempo e/o a valore; non vengono sostituite o rimborsate nemmeno, a titolo esemplifi cativo, tessere inutilizzate, o anche solo parzialmente utilizzate, smarrite, ritirate, bloccate, annullate, sospese o deteriorate deliberatamente.11. Le tessere Dolomiti SuperSummer vengono concesse all’utilizzatore in comodato d’uso. L’utente è responsabile della buona conservazione della tessera, che rimane di proprietà dell’emittente.12. La tessera a tempo e la tessera a valore, quali documenti di trasporto, necessari ed insostituibili per l’accesso agli impianti di risalita aderenti all’iniziativa e per il trasporto del titolare come descritto all’art. 1, assolvono la funzione dello scontrino fi scale (D.M. 30/06/1992 e successive integrazioni e modifi che) e vanno conservati per tutta la durata del trasporto.13. Non è garantito il funzionamento ininterrotto, durante tutto il periodo di apertura indicato, degli impianti di risalita aderenti all’iniziativa, essendo gli stessi condizionati da alcuni fattori fuori dalla sfera di controllo degli esercenti, quali a titolo meramente esemplifi cativo, le condizioni meteorologiche e di sicurezza, guasti all‘impianto, la disponibilità delle fonti energetiche, disposizioni delle autorità e impedimenti dovuti ad altre cause di forza maggiore.14. I prezzi per l‘acquisto delle tessere, nonché il valore delle singole corse (nella misura delle unità scalate dalle tessere a valore), potranno subire variazioni in caso di eccezionali interventi di ordine fi scale, valutario, economico o sociale.15. Con l’acquisto e/o con l’utilizzo della tessera a tempo oppure della tessera a valore, l’utente dichiara di conoscere e accettare integralmente le presenti Condizioni Generali di Vendita, disponibili presso i punti vendita, presso i principali impianti di risalita aderenti nonché sul sito internet DOLOMITISUPERSUMMER.com.16. In caso di discrepanze tra le versioni linguistiche delle presenti Condizioni Generali di Vendita, vale e fa fede la versione in lingua italiana delle stesse.17. Per ogni controversia relativa alla validità ed esecuzione del contratto di trasporto e delle presenti Condizioni Generali di contratto è applicabile il diritto italiano e saranno competenti in via esclusiva i Giudici del Foro di Bolzano.

ALLGEMEINE VERKAUFSBEDINGUNGEN Ausgabe: S01-2018

1. Die vorliegenden Allgemeinen Verkaufsbedingungen enthalten die Vertragsbedingungen für den Erwerb und die Nutzung von Dolomiti SuperSummer Zeit- und Wertkarten.Beide Karten sind reine Fahrkarten für die Personenbeförderung, mit denen die Aufstiegsanlagen der an der Initiative Dolomiti SuperSummer teilnehmenden Unternehmen genutzt werden können. Das Verzeichnis der beigetretenen Aufstiegsanlagen liegt an allen Verkaufsstellen und größeren teilnehmenden Aufstiegsanlagen auf und wird auch auf der Website DOLOMITISUPERSUMMER.com veröff entlicht.Die Fahrkarten Dolomiti SuperSummer, gemäß den in den nachstehenden Artikeln 3 und 4 beschriebenen Bedingungen, werden vom 01.06.2018 bis zum 04.11.2018 an den, der Initiative beigetretenen Aufstiegsanlagen angenommen. Allerdings sind nicht alle Anlagen im gesamten Gültigkeitszeitraum auch in Betrieb. Im oben erwähnten Verzeichnis werden für jede teilnehmende Aufstiegsanlage auch die Betriebs- und Öff nungszeiten angegeben.2. Das Konsortium Dolomiti Superski, Aussteller der zuvor erwähnten Fahrkarten, sowie die ihm angeschlossenen Talschaftsverbunde handeln im Auftrag mit Vertretungsmacht der einzelnen Unternehmen, welche die Aufstiegsanlagen betreiben (die Auftraggeber), denen ausschließlich der Betrieb und die Führung der Anlagen sowie die Verantwortung der Beförderungsdienstleistung obliegt. Die an der Initiative Dolomiti SuperSummer teilnehmenden Betreiber sind somit, zusammen mit den Nutzern, die alleinigen und ausschließlichen Vertragspartner des vorliegenden Beförderungsvertrags, für den eine Beteiligung und Haftung seitens des Konsortiums Dolomiti Superski und der ihm angeschlossenen Talschaftsverbunde ausgeschlossen sind, da beide im Namen und im Auftrag der an der Initiative teilnehmenden Unternehmen handeln.3. Die Benutzung der Zeitkarte am Kontroll-Drehkreuz berechtigt den rechtmäßigen Inhaber zur Nutzung der, der Initiative Dolomiti SuperSummer beigetretenen Aufstiegsanlagen. Je nach erworbenem Kartentyp ist die Karte einen Tag bzw. an drei, auch nicht aufeinanderfolgenden Tagen auf vier, oder an fünf, auch nicht aufeinanderfolgenden Tagen auf sieben gültig. Die Gültigkeitsdauer der Karten kann in keinem Fall abgeändert werden.Die Karte ist streng persönlich und weist die Gültigkeitsdauer und ein Kürzel mit den Buchstaben M, F, J oder B auf, die jeweils die Zuordnung des Karteninhabers zu Mann, Frau, Junior (geboren nach dem 01.06.2002) oder Kind (geboren nach dem 01.06.2010) darstellen. Die Zeitkarte kann außerdem mit dem Vor- und Nachnamen und/oder einem Foto des zur Nutzung berechtigten Inhabers versehen sein. Persönliche Daten der Nutzer werden in keiner Form, weder auf Papier noch in elektronischer Form, gespeichert, aufbewahrt oder verarbeitet. Es erfolgt somit keine Verarbeitung persönlicher Daten. Die Zeitkarte kann nicht abgetreten werden, auch nicht unentgeltlich, und darf nicht ausgetauscht oder manipuliert werden. Um eine für einen Junior (J) oder für ein Kind (B) vorgesehene Ermäßigung auf einer Zeitkarte zu erhalten, müssen beim Erwerb der Fahrkarte das Kind oder der Junior anwesend sein und ein gültiger Personalausweis vorgewiesen werden; beide Anforderungen bilden die Voraussetzungen zur Gewährleistung der genannten Ermäßigungen, wie in den in diesem Informationsschreiben nachfolgend beschriebenen Fällen und Ausmaßen vorgesehen. Das Informationsschreiben ist in den Verkaufsstellen erhältlich sowie auf der Website DOLOMITISUPERSUMMER.com veröff entlicht. Ein Ersatz des Personalausweises durch Vorweisung einer Eigenerklärung ist nicht gestattet.Um die kostenlose Zeitkarte für Kinder (geboren nach dem 01.06.2010) zu erhalten, muss gleichzeitig eine Zeitkarte derselben Art und für denselben Zeitraum seitens einer erwachsenen Begleitperson erworben werden, die mit der Kinderkarte gekoppelt wird. Pro zahlende erwachsene Begleitperson kommt dabei je ein Kind (B) in den Genuss einer kostenlosen Karte.Die Zeitkarte gilt ausschließlich für die Beförderung von Personen. Für die Beförderung von Fahrrädern, Kinderwagen, Koff ern, Tieren, sowie von anderen Gegenständen und anderem Zubehör gelten die von den einzelnen Aufstiegsanlagen vorgesehenen Bedingungen. Der Nutzer ist damit verpfl ichtet, Informationen zu einem solchen Transport an den Kassen der jeweiligen Aufstiegsanlage einzuholen. Auf Anlagen, die mit dem Fahrrad-Verbotshinweis* gekennzeichnet sind, ist die Beförderung von Fahrrädern nicht erlaubt.4. Die Wertkarte dagegen ist nicht persönlich und kann somit auch übertragen werden. Die Gültigkeit der Karte ist auf die Sommersaison beschränkt, für die sie ausgestellt wurde. Die Benutzung der Wertkarte am Kontroll-Drehkreuz berechtigt den Inhaber und seine Begleiter zur Nutzung der im genannten Verzeichnis angegebenen Aufstiegsanlagen, mit Ausnahme der Aufstiegsanlagen bei welchen die Wertkarte nicht angenommen wird. Beim Erwerb der Wertkarte beträgt der anfängliche aktive Saldo je nach erworbenem Kartentyp 800 bzw. 1.400 Einheiten. Bei jeder Nutzung derselben werden von der verfügbaren Restmenge der Karte die Anzahl der für jede Nutzung der einzelnen Aufstiegsanlage erforderlichen Einheiten abgezogen; die Anzahl der erforderlichen Einheiten pro Anlage ist im bereits mehrfach genannten Verzeichnis und in jedem Fall bei der teilnehmenden Aufstiegsanlage sowie auf der Website DOLOMITISUPERSUMMER.com angegeben.Die Wertkarte gilt nur für die Beförderung von Personen. Für die Beförderung von Fahrrädern, Kinderwagen, Koff ern, Tieren, sowie von anderen Gegenständen und anderem Zubehör gelten die von den einzelnen Aufstiegsanlagen vorgesehenen Bedingungen. Der Nutzer ist damit verpfl ichtet, Informationen zu einem solchen Transport an den Kassen der jeweiligen Aufstiegsanlage einzuholen. Auf Anlagen, die mit dem Fahrrad-Verbotshinweis* gekennzeichnet sind, ist die Beförderung von Fahrrädern nicht erlaubt.Kindern, die nach dem 01.06.2010 geboren sind und von einem erwachsenen Inhaber einer gültigen Wertkarte begleitet werden, wird durch den Betreiber der Aufstiegsanlage bei Nutzung der Wertkarte freie Fahrt gewährt, wobei dem Betreiber mögliche vorgeschriebene steuerrechtliche Aufl agen obliegen. Zum Zeitpunkt der Nutzung der Aufstiegsanlage muss ein gültiger Personalausweis vorgewiesen werden, der die Voraussetzung für die zu gewährende kostenlose Fahrt für Kinder bescheinigt; ein Ersatz durch eine abgegebene Eigenerklärung ist nicht gestattet. Für jede zahlende erwachsene

Begleitperson wird einem Kind (B) die kostenlose Fahrt gewährt. 5. Zu Beginn und Ende der Sommersaison ist die Schließung einzelner Aufstiegsanlagen, größerer Gruppen von Aufstiegsanlagen sowie von Anlagen in größeren Gebieten, zusätzlich zu den im Art. 13 angegeben Gründen, auch in Anbetracht der Besucherzahlen, der Verfügbarkeit von Pfaden und Wegen, sowie aus Sicherheitsgründen möglich. Die eventuelle Schließung erfolgt infolge von Entscheidungen, die eigenständig von den einzelnen Betreibern der Aufstiegsanlagen getroff en werden und an denen Dolomiti Superski und die Talschaftsverbunde nicht beteiligt sind.6. Gegenstand des Vertrages ist ausschließlich die Personenbeförderung von der Tal- zur Bergstation der jeweiligen Anlage und/oder umgekehrt. Jede weitere Aktivität (Trekking, Mountainbiking, auch innerhalb der „Bike Parks“ oder ähnlicher Einrichtungen), ist nicht Gegenstand des Vertrages und erfolgt für jeden Einzelnen ausschließlich auf eigenes Risiko und auf eigene Gefahr. Die Wege und Routen stehen nicht im Eigentum der Betreiber der Aufstiegsanlagen, des Konsortiums Dolomiti Superski oder der Talschaftsverbunde, die somit dieselben auf keine Weise betreiben und demzufolge weder prüfen und begutachten noch instand halten können. Das Konsortium Dolomiti Superski und die Talschaftsverbunde sind außerdem nicht die Eigentümer von „Bike Parks“ oder ähnlichen Einrichtungen und sind somit nicht für deren Betrieb und Überwachung verantwortlich, was ausschließlich den Betreibern und/oder den Eigentümern derselben obliegt. In jedem Fall sind die Nutzer verpfl ichtet, die an jeder Anlage einsehbaren Bestimmungen für Fahrgäste zu beachten und sorgfältig einzuhalten.7. Der Betreiber der jeweils genutzten Aufstiegsanlage haftet nicht für eine unsachgemäße Benutzung der Anlagen, sowie für die Folgen unerlaubter Handlungen der Nutzer während ihres Aufenthalts auf den Aufstiegsanlagen. Mit der Nutzung der Aufstiegsanlage erklärt der Nutzer der Dolomiti SuperSummer-Karten, die zivilrechtliche Haftung (Art. 2047 und 2048 des Italienischen Zivilgesetzbuches) bezüglich der Aufsichtspfl icht gegenüber Minderjährigen auch während der Nutzung der Anlagen zu kennen und alle geltenden Vorschriften und gesetzlichen Regelungen der Staats-, Regional- und Landesgesetzgebung zu beachten. Die Beförderung eines Kindes erfolgt unter Aufsicht, Verantwortung und Überwachung der erwachsenen Begleitperson, wobei jegliche Haftung des Betreibers der Aufstiegsanlage ausgeschlossen ist. Die Verantwortung seitens der Eltern oder des gesetzlichen Vertreters der Minderjährigen wird bei einer Nutzung der Aufstiegsanlagen durch letztere vorausgeschickt.8. Nutzer müssen ihre Dolomiti SuperSummer-Karten auf Auff orderung des Dienstpersonals oder der Inspektoren vorzeigen und die Identifi zierung ihrer Person gestatten.9. Jede missbräuchliche Nutzung der zuvor erwähnten Fahrkarten hat unverzüglich den Entzug, die Annullierung oder Gültigkeitsaussetzung der betreff enden Fahrkarten zur Folge. Sowohl die Zeit- als auch die Wertkarten können außerdem bei einer Verletzung der bestehenden Vorschriften der Staats-, Regional- oder Landesgesetzgebung von der zuständigen Aufsichtsbehörde entzogen oder deren Gültigkeit ausgesetzt werden. Im Falle einer missbräuchlichen Nutzung von Zeitkarten für Kinder (B) unter 8 Jahren werden sowohl die kostenlose Karte als auch die mit dieser beim Erwerb gekoppelten Erwachsenenkarte gesperrt und/oder annulliert. Jedweder Missbrauch wird gerichtlich geahndet: der Rechtsweg einschließlich eventuell erforderlicher Klagen zur Feststellung strafrechtlicher (z.B. Betrug gemäß Art. 640 des Italienischen Strafgesetzbuches) oder zivilrechtlicher Haftung des Übertreters bleibt vorbehalten.10. Jegliche Form des Austausches oder der Rückerstattung wird ausgeschlossen; so werden zum Beispiel nicht genutzte oder auch nur teilweise genutzte, verloren gegangene, entzogene, gesperrte, annullierte, ausgesetzte oder mutwillig beschädigte Zeit- und Wertkarten weder ersetzt noch rückerstattet.11. Die Dolomiti SuperSummer-Karten werden dem Nutzer als Leihgabe ausgehändigt. Der Nutzer ist für eine sorgfältige Verwahrung der Karte verantwortlich, die Eigentum des Ausstellers bleibt.12. Als Transportdokument erfüllen die Zeit- und Wertkarten die Aufl agen eines Steuerbeleges (Ministerialdekret vom 30.06.1992 und nachfolgenden Ergänzungen und Änderungen) und müssen deshalb für die gesamte Dauer der Beförderung aufbewahrt werden. Beide Karten sind für den Zugang zu den Aufstiegsanlagen erforderlich und für den Transport des Karteninhabers, wie im Art. 1. beschrieben, unerlässlich und unersetzlich.13. Der Betrieb, der an der Initiative teilnehmenden Aufstiegsanlagen, ist nicht ständig und während des gesamten angegebenen Betriebszeitraums gewährleistet, da der Betrieb auch von einigen Faktoren abhängig ist, die nicht im Einfl ussbereich der Betreiber liegen, wie zum Beispiel Witterungs- und Sicherheitsverhältnisse, Ausfälle der Anlagen, Verfügbarkeit der Energiequellen, Verfügungen durch Behörden und andere Gründe höherer Gewalt. 14. Die Preise für den Erwerb der Karten und der Wert der Einzelfahrten (im Sinne der Anzahl der abgezogenen Einheiten bei Nutzung der Wertkarten) können aufgrund außerordentlicher Maßnahmen steuerrechtlicher, währungspolitischer, wirtschaftlicher oder sozialer Natur abgeändert werden.15. Mit dem Erwerb und/oder mit der Nutzung einer Zeit- oder Wertkarte erklärt der Benutzer, die vorliegenden Verkaufsbedingungen zu kennen und im vollen Umfang anzunehmen; die vorliegenden Allgemeinen Verkaufsbedingungen können bei allen Verkaufsstellen, bei den größeren teilnehmenden Aufstiegsanlagen und auf der Website DOLOMITISUPERSUMMER.com eingesehen werden.16. Bei Unklarheiten und Abweichungen zwischen den verschiedenen Sprachfassungen gilt die italienische Fassung dieser Verkaufsbedingungen.17. Bei Streitigkeiten über die Gültigkeit oder die Ausführung des Beförderungsvertrags oder der vorliegenden Allgemeinen Verkaufsbedingungen gilt italienisches Recht, wobei ausschließlich die Richter des Gerichtsstandes Bozen zuständig sind.

major areas of lift facilities may be not operational, the reasons being as provided by article 13 but also in regard to the infl ux of persons using the lift or lifts, the proper functioning of routes and paths as well as in regard to safety reasons in general. Potential inactivity of lift system facilities will depend on the owners’ and operators’ autonomous decision, which the Dolomiti Superski Consortium and the adhering Valley Consortia are not entitled to interfere with, resulting therefore beyond their sphere of competence.6. Both cards entitle to the transport of persons from the bottom station to the top station and/or vice versa. Any additional activity performed by each individual user additionally to the use of the lift system facility (e.g. trekking, mountain biking, also in “bike parks” or similar facilities) is not covered by the contract and is performed exclusively at one’s own risk. ² e paths and routes are not property of and therefore not managed in any manner by the facility’s owners or operators nor of the Dolomiti Superski Consortium, nor of the local valley consortia, hence they do not accept any responsibility for their care, control or maintenance. ² e Dolomiti Superski Consortium, and the local valley consortia, are not owners of any of the “bike parks” or similar structures and as such they are not responsible for their management or supervision, a responsibility which remains exclusively that of the operators appointed for the management of the above mentioned structures and/or the owners themselves. It however remains the obligation of every user to strictly observe and respect the conditions for use (the facility user guidelines) displayed at the access station of every lift system facility.7. ² e owners and operators of lift system facilities decline any responsibility or liability for damages arising from improper use of the lift facilities as well as for the consequences of cardholders’ incorrect and illicit behaviour performed on the transportation circuit. By using the lift system facilities, holders of the Dolomiti SuperSummer cards acknowledge their awareness and express acceptance of their liabilities under the provisions of the Italian Civil Code (art. 2047 and art. 2048) both, in relation to the supervising and control duties of minors also during their use of the lift facilities. In addition lift system facilities’ user declare to be aware of and agree to follow all the provisions and norms, inclusive of those set by national, provincial and regional regulations, governing the attendance at and use of the lift facilities. Facilities’ use by children is nonetheless considered as taking place under the exclusive responsibility, care, control and supervision of the accompanying adult cardholder or more generally of the parents or legal representatives of the minors, assuming responsibility for the use of the particular lift system facilities by the child, and without liability of the owners or operators of each individual lift facility. 8. ² e Dolomiti SuperSummer card must be shown upon request of the staff at the facilities as well as to the inspectors and cardholders have to allow them to check users’ personal identity.9. Cardholders acknowledge and accept that any improper or incorrect use of the abovementioned cards will lead to the immediate withdrawal, annulment or suspension of the card itself. Both the period cards and the points value cards may be withdrawn or suspended by authorized staff or control personnel in case of any violation of provisions set by provincial or regional regulations or by statute law. In case of improper use of the period cards issued free of charge to children (B) aged less than 8 years, both the card issued free of charge as well as the coupled adult card will be blocked and/or withdrawn. Every improper use will be prosecuted according to law and through any legal action or proceeding deemed necessary or proper for ascertaining the infringer’s criminal (e.g. for fraud - article 640 of the Italian penal code) and/or civil liability.10. Each form of replacement or refund of period cards and/or points value cards will be excluded. Cardholders acknowledge that no replacement will be made and no right of refund or reimbursement will be recognized neither for e.g. cards being not used, even if only partially, nor for cards being lost, withdrawn, blocked, annulled, suspended or being deliberately damaged.11. Cardholders acknowledge and accept that the Dolomiti SuperSummer cards are temporarily assigned to them under terms of loan for use. Cardholders are therefore responsible for their own card’s proper use and conservation and it remains property of the issuing company.12. ² e period card and the points value card, being transport documents, fulfi l the function of a tax receipt (in the meaning of Ministerial Decree of June 30th 1992 and successive amendments and integrations) and must therefore be kept for the entire duration of the lift systems‘use. Both cards are necessary to access the lifts and are indispensable and irreplaceable for the transport of the card’s holder, as described in article 1.13. Cardholders accept and acknowledge that the continuous opening and functioning of all lift system facilities partaking in the Dolomiti SuperSummer initiative are not always guaranteed throughout the whole indicated operating period, as the functioning is conditioned by factors out of the control sphere of the facility’s owners and operators, such as e.g. weather and safety conditions, damages of the facility, lack of energy sources, any resolution made and/or implemented by the local authorities and other causes of force majeure.14. Card prices as well as prices for lift system facilities’ usage (i.e. units charged using a points value card) may be subject to changes in the case of exceptional intervention by fi scal, monetary, economic or social authorities.15. By purchasing and/or by using the period card or the points value card, users declare to know and to completely accept the present General Sales Conditions, which are available at the sales offi ces, at the main participating lift system facilities, as well as on the website DOLOMITISUPERSUMMER.com.16. In the eventuality of contrast or diff erences between the various language versions of the General Sales Conditions and the Italian text, the Italian version is to be considered as the only binding one.17. All disputes potentially arising with respect to the validity and the execution of the transportation agreement and with respect to the present General Sales Conditions will be subject to the jurisdiction of the court of Bolzano/Bozen.

1. ² e present General Sales Conditions represent the contractual conditions regulating the purchase and the use of the Dolomiti SuperSummer period cards and points value cards.Both cards enable cardholders to use the lift system facilities of the companies participating in the Dolomiti SuperSummer initiative. ² e list of all participating lift system facilities is available at each sales offi ces, at the main partaking lift system facilities, as well as on the website DOLOMITISUPERSUMMER.com.² e Dolomiti SuperSummer cards, in accordance with the specifi cations as described in the art. 3 and 4, will be accepted on the lift system facilities from June 1st 2018 until November 4th 2018. Not all lift system facilities will however be open throughout the entire indicated period. Cardholders acknowledge that both the Dolomiti Superski Consortium, which issues the Dolomiti SuperSummer transportation cards referred to in the preceding paragraph, as well as the adhering local valley consortia, act on the strength of a specifi c agency agreement (with disclosed principal) assigned to them by autonomous companies operating the lift system facilities (the principal contractors), who are exclusively responsible for the management and operation of the respective lift facilities and their connected transportation services. ² erefore, the companies operating the lift facilities, partaking in the Dolomiti SuperSummer initiative, and the cardholders themselves are to be considered as the only contracting parties to the present transport agreement. ² e Dolomiti Superski Consortium and the local valley consortia, both referred to acting on behalf of the companies taking part in the initiative, are therefore not to be considered as part of such agreement and will not be subject to any form of liability.3. ² e use of the period card at the control gates allows the legitimate cardholder to utilize the lift system facilities participating in the Dolomiti SuperSummer initiative. ² e card has a validity of either one day, three out of four days or fi ve out of seven days, depending on the chosen card type. ² e days need not necessarily be consecutive one to the other. ² e validity period cannot be changed in any form or manner once the card has been issued.² e card is strictly personal, carrying its period of validity and an additional sign, consisting in the letters M-F-J or B, indicating M=Male, F=Female, J=Junior (born after June 1st 2002) or B=Child (born after June 1st 2010). ² e card can also carry the name and/or the picture of the cardholder legitimated to its use. Personal data of users will not be saved in any form, neither on paper nor electronically, and therefore no personal data processing will take place. ² e period card cannot be transferred to other persons even if no charge is involved, nor changed for another, nor modifi ed or altered in any manner. In order to benefi t from the discounts off ered for Juniors (J) and Children (B) on the period cards, at the moment of purchase of the period card, the actual presence of the Junior or Child for whom the benefi t is being asked for is necessary and applicants have to provide a valid identity card of theirs, which cannot be substituted by any self-certifi cation or similar procedures, and so substantiating the fulfi lment of the requirements necessary for claiming the benefi ts assigned in these instances, and to the extent as described in the present information sheet available at the sales offi ces as well as on the website DOLOMITISUPERSUMMER.com.² e free period card for children (B) born after June 1st 2010 is granted only in connection with the simultaneous purchase by an accompanying adult of a period card of the same kind and for the same period as that of the child for which the gratuity is given. For each purchased adult period card only one free of charge child period card will be issued, in the ratio of one child (B) for one paying adult attendant. Both the child card and the adult card will be coupled. ² e period card enables the transportation of the cardholder only. For the transport of bikes, prams, luggage, animals and any other items and accessories the terms and conditions are determined by the individual lift system facility. It is the obligation of the user to inform himself or herself at each single lift system of the regulations pertaining to the individual lift facility. On lift system facilities exhibiting the specifi c sticker* the transport of bikes is not allowed.4. ² e points value card however is not personal, and therefore may be freely transferred to other parties, and will be valid solely and exclusively for the season in question it has been issued for. ² e use of the points value card, at the control gates, entitles cardholders and their companions to utilize the lift system facilities indicated in the abovementioned list, with exception of the lift facilities where the points value cards are not accepted. At the moment of purchase the card will off er respectively an initial amount of 800 or 1,400 units, depending on the chosen card type. At each access to a single lift system facility the number of units assigned for the use of the specifi c facility will be charged on the card and deducted from the total amount of the available units. ² e amount of units charged for the use of each specifi c lift system facility is indicated in the aforementioned list, at the access station of the participating lift facilities, as well as on the website DOLOMITISUPERSUMMER.com. ² e points value card enables the transportation of persons only. For the transport of bikes, prams, luggage, animals and any other items and accessories the terms and conditions are determined by the individual lift system facility. It is the obligation of the user to inform himself or herself at each single lift system facility of the regulations pertaining to the single lift system. On lift system facilities exhibiting the specifi c sticker* the transport of bikes is not allowed. Children (B) born after June 1st 2010, are entitled to a free access and free use of the lift system facilities, provided they are accompanied by an adult holder of a valid points value card and the card is used at the same time at the lift system facility, the owners of the lift system facility however remaining responsible for the fulfi lment of any fi scal requirements as provided for by the law. In order to benefi t from the free use of the lift system facilities, applicants have to provide, at the moment of use of the facilities, a valid identity card of the child, substantiating the fulfi lment of the requirements necessary for claiming the assigned benefi ts. Such ID substantiation cannot be replaced by any self-certifi cation or similar procedures. For each paying adult attendant only one child (B) can access the facility free of charge. 5.
