The Plaintiff, Santo Trafficante, y his undersigned attorney moves

this Honorable Court to Quash a subpoena i ssued y the Defendants described

in the caption hereinabove, a true copy of which is attached as Exhibit A hereto,

and as grounds for this motion, says:

1. The subpoena is vague; indefinite and uncertain in that i t

commands the Plaintiff to appear and produce the sa id books and records but

fails to identify or specify sa id books and records.

2. That on or about Spetember 6, 1968, the Defendant , Robert L.

Shevin, made a public statement that one of the main purposes of the Committee

of which he is Chairman is to bring the spotlight of public attention on the

alleged criminal activit ies of certain individuals-living in their o m m u n i t y ~ ·

3. That on or about September 6, 1968, the Defendant, Robert L.

Shevin, made a public statement that the Committee of which he is Chairman

is not out to ask idle questions of witnesses called before the committee but

that every question asked is based on intelligence information I and that

what is upper most in our minds, is whether or not these individuals will con-

above stateme nts of Defendant Shevin exceed the scope, authority, and

permissib l e limits of a legislative body and is not a valid legislative objective;

that the use of the compul sory process described here in violates the rights of

the Plaintiff as guaranteed by the First   Fourth, Fifth and Fourteenth Amendments

to the Constitution 'o f the United States and by the Declaration of Rights of the

Constitution of the State of Florida.

5 . That the resolution, act or c harter of the Se lect Committee to

Investigate Organized Crime and Law Enforcement of th e Florida Legislative

Council from which i ts authority is derived from the legislature is so vague and

nebulous that i t violates due process as guaranteed by the Fifth and· Fourteenth

Amendments to the Constitution of the United States and by the Dec laration of

Rights.

6 . That the said Select Committee is improp er ly attempting to try,

and punish suspects, a task w hich is constitutionally denied to the legislature

and which is exclusively the province o f the Courts with all the safeguards

provided by the State and Federal Constitution.

7 . That the subject of the inquiry be ing undertaken by the said

Select Committee is so vague as to deprive the Plaintiff of his rights guaranteed

by the above ·described amendments to the d e r l Constitutio n and by the said

Declaration of Rights .

8. That on October 8, 1968, th e Plaint iff informed the Defendant

Shevin that in view of his public statements described above that the Plaintiff

would claim his privilege under the Fifth Amendment to the Federal Co nstitution

to all que stions propo unded to him, save and except his name and address , and

respec tfully requested that the said subpoena be withdrawn.

9. That on October 9   1968, Defendant Shevin denied the P laintiff 's

be issued forthwith restraining the defendants from attempting to enforce said

subpoena a _nd that upon final hearing that said subpoena be quashed.

LANSKY was the organized crime boss of gambling interests in Cuba

prior to the take over of Cuba by CASTRO on 1 January 1959. One of

LMNSKY1 s subordinates for Cuban gambling operations was S ~ ~ Santo

(Santos) TRAFFICANTE. The fol owin3 informatio n is from an ar t ic le in

t ;,e April 1970 edition of True magazine, captioned, 11 The Mafia Vs. the

CIA by Andrew St. George. For the most-part , the art ic le deals with

attempts by LANSKY to reestablish a gambling empire in the Carribean

in the mid-1960 1s namely in Haiti. In substance, the author relates

that:

became a money mover to keep Meyer LANSKY s money from CASTRO. Allegedly

because the District Attorney wanted tht

men "to sing before a grand jury on

crime in Queens" but "a judge set bail

at $100,000 each," which was met.

Actually the lunch which was picturedtook place one week after the originalone (which had been broken up by police)during a break in the Grand Jury proceedings, and not later on the day of the

arrests as the article might be read toimply. Two of the seven men picturedwere attorneys who represent one or

more of the alleged "hoodlums" withwhom they were sitting. No mentionwas made in the article of the fact that

in Florida. said yesterday he v;as once an "interpreter"in a plot to kill Fidel Castro, but he knew nothing ofany conspiracy to kill John F. Kennedy

Sometimes sipping coffee or tapping his fingernailon the microphone. the much-feared mobster traced hislife as a young gambling entrepreneur in pre-CastroCuba. his restful days after the revolution in a Havanajail. and his later meetings with CIA officials in theFontainebleau Hotel in Miami to plot Castro's murder.

During the Kennedy Administration. he sa1d he

found himself under constant surveillance "from neighbors, from hiUtops, from trees, from cars, from anything." While some of his friends did not appreciatethis sort of treatment, he said he never heard anyonethreaten to retaliate.

After first giving his name and address - 740 NE55th St.. North Miami - Trafficante invoked the

Fifth Amendment to avoid testifying . He was thengranted a limited immunity and he agreed to speak,after his burly lawyer, Henry Gonzalez, won assurances that none of the questions would be based onelectronic monitoring.

"I'm retired," said Trafficante, 63. at the outset.Some spectators tittered.

He said he moved to Havana in about 1953 andspent the next seven years in the gambling business"which was legal at that time in Cuba."

Once in mid-1959, Trafficante said. he spent amouth iR Irescornja Detentjon Camp, where Castro

kept casino operators and others who up for deporta-tion. "It was like one big, happy family. he said. "Ireally had a rest there, if you want to know the truth.''

Trafficante is the first man involved in the Castroassassination plots to testify in public, and minimizedhis own role despite CIA documents Indicating he was

the courier who carried a poison pill from the CIA toone of the Cuban plotters.

He said in late 1960 or early 1961 John Roselli, anold friend, approached him at the Fontainbleau Hotel inMiami and told him the CIA and the U.S. government"was interested in eliminating Castro."

Trafficante said his "total involvement was serving as an interpreter between the two CIA representatives - Roselli and Robert Maheu - a nd some Span· ,ish-speaking Cubans who wanted to overthrow Castro.

Trafficante was questioned in detail about Wednes·day's testimony by Jose Aleman, a Miami-based Cuban
