PER CURIAM:
[1] This appeal is taken from an or
der of the district court denying the peti
tion of a federal convict for relief against
th e paro le board. We affirm.l
Appellant's petition, entitled an Ap
plication for Issuance of Writ of Man
damus and Expedition (s ic ) Relief, was
considered 9y the district court as a peti
tion for writ of habeas corpus. While
the petit ion should properly have been
considered as one seeking mandamus re
lief, failure to treat i t as such did not
prejudice appellant.
Appellant ori ginally sought relief in
the United States District Court for the
District of Columbia and his petition was
transferred to the United States District
Court for the Northern District of
Georgia when i t appeared that he was
both se nt enced and confined in the latter
di strict . His petition sought an order
requiring the United States Par ole Board
time fixed by R nle 31, Federal Rules ofAppellate Procedure. Kimbrough v Bcto,Director, 5th Cir. 1969, 412 F.2d 981.

WASHINGTON - Santos 'frafhcante, the bird·likelittle man who reputedly presides over organized crtme
in Florida. said yesterday he v;as once an "interpreter"in a plot to kill Fidel Castro, but he knew nothing ofany conspiracy to kill John F. Kennedy
"I am >\Ire as .am sitting here that f n e v ~ r madethe statement that Kennedy would be hit," Trafficantetold the House Assassinations Committee.
Sometimes sipping coffee or tapping his fingernailon the microphone. the much-feared mobster traced hislife as a young gambling entrepreneur in pre-CastroCuba. his restful days after the revolution in a Havanajail. and his later meetings with CIA officials in theFontainebleau Hotel in Miami to plot Castro's murder.
During the Kennedy Administration. he sa1d he
found himself under constant surveillance "from neighbors, from hiUtops, from trees, from cars, from anything." While some of his friends did not appreciatethis sort of treatment, he said he never heard anyonethreaten to retaliate.
After first giving his name and address - 740 NE55th St.. North Miami - Trafficante invoked the
Fifth Amendment to avoid testifying . He was thengranted a limited immunity and he agreed to speak, after his burly lawyer, Henry Gonzalez, won assurances that none of the questions would be based onelectronic monitoring.
"I'm retired," said Trafficante, 63. at the outset. Some spectators tittered.
He said he moved to Havana in about 1953 andspent the next seven years in the gambling business"which was legal at that time in Cuba."
Once in mid-1959, Trafficante said. he spent amouth iR Irescornja Detentjon Camp, where Castro
kept casino operators and others who up for deporta-tion. "It was like one big, happy family. he said. "Ireally had a rest there, if you want to know the truth.''
Chairman Louis Stokes (D·Ohio · ackRub · · · t 1a, as was hinted in We -
ay's testimony. "1 never remember meeting Jackuby ," the witness answered.
ey was no o ve m joining a CIA-spon-sored plot on Fidel Castro's life a few months later, heinsisted.
It was just like registering for the draft in WorldWar II, he said. I t was the same thing as war."
Trafficante is the first man involved in the Castroassassination plots to testify in public, and minimizedhis own role despite CIA documents Indicating he was
the courier who carried a poison pill from the CIA toone of the Cuban plotters.
He said in late 1960 or early 1961 John Roselli, anold friend, approached him at the Fontainbleau Hotel inMiami and told him the CIA and the U.S. government"was interested in eliminating Castro."
Trafficante said his "total involvement was serving as an interpreter between the two CIA representatives - Roselli and Robert Maheu - a nd some Span· ,ish-speaking Cubans who wanted to overthrow Castro.
Trafficante was questioned in detail about Wednes·day's testimony by Jose Aleman, a Miami-based Cuban

exile leader, tbat Trafficante once predicted that Kennedv would be hit.
Trafficante recalled several meetings with Aleman, the first to discuss a possible construction loan from
the Teamsters Union pension fund to Aleman.rt is possible, said Trafficante, that be may bave
told Aleman that Kennedy would not be re-elected in1964. But there was never any talk of Kennedy beinghit.
