Articolo 4 - Responsabilità dello Stato membro di cura 1. ... l’assistenza sanitaria transfrontaliera è prestata conformemente:
a) alla legislazione in vigore nello Stato membro di cura;
b) agli standard e agli orientamenti di qualità e sicurezza definiti dallo Stato membro di cura; e
c) alla normativa dell’Unione in materia di standard di sicurezza.
«Stato membro di cura»: lo Stato membro nel cui territorio viene effettivamente prestata al paziente l’assistenza sanitaria. Nel caso della telemedicina, l’assistenza sanitaria si considera prestata nello Stato membro in cui è stabilito il prestatore di assistenza sanitaria;

Tutti i sistemi di accreditamento regionali dovranno infatti uniformarsi ai contenuti del “Disciplinare tecnico” (Intesa 20 dicembre 2012) che individua 8 criteri, 28 requisiti essenziali e 123 evidenze, nei tempi previsti dall’Intesa del 19 febbraio 2015.
